Violations Involving an Ignition Interlock Device

Texas increasingly requires that motorists install a device onto their car, called an ignition interlock device or IID. This is essentially a small breathalyzer that you need to blow into. If the alcohol concentration in your breath is too high, the vehicle doesn’t start. Unfortunately, some people tamper or try to circumvent the device, and there are serious consequences if they get caught. Why You Need to Install an Ignition Interlock Device (IID)

Texas law requires installation in certain situations, such as:

  • As a condition of bond if this is your second or subsequent DWI
  • If you are under 21 and this is your first offense
  • First offenders with a high blood alcohol concentration (0.15% or higher)

You can also get an unrestricted occupational driver’s license if you install an IID after conviction. So many people will choose this option after the court suspends their license.

How IID Laws are Violated

The IID is for your own safety, and for the safety of the public. It will prevent you from driving while intoxicated, thus preventing accidents. Unfortunately, some people violate the IID law:

  • Tampering with the device. Some people try to remove the device or otherwise alter it. This is prohibited by the law.
  • Circumventing the IID. For example, you might have someone else blow into the device but then get into the driver’s seat to start driving. This is also illegal.
  • Driving with alcohol in your system. You might start drinking after starting up your vehicle. Consequently, you can end up with alcohol in your system in violation of the law. If pulled over, you face an additional DWI charge—and good luck convincing a judge to let you drive with an IID.
  • Driving a vehicle without an IID installed. Some people have multiple vehicles, or they borrow a friend’s car to drive it. Even if you are sober, you have violated the law.

Violations can result in serious consequences. For example, you can lose your driving privileges completely. This bracelet will result in more frequent alcohol monitoring, even when you aren’t trying to drive. It can be embarrassing to go into work wearing this bracelet.

You might also have probation revoked. You could end up behind bars, much as you would if the judge had just convicted you without giving you probation at all. This is perhaps the most dramatic consequence—and one to be avoided.
